The Mental Capacity Act

Many people in society suffer from forms of mental illness or have learning difficulties that make it more difficult for them to understand things that most people would easily understand. The Mental Capacity Act is a law that tells organisations what they have to do when faced with someone who has difficulty understanding what the organisation actually does.

It is unlikely that we will be faced with someone who arrives for a scan but does not understand what a scan entails as we are a paid for service that the pregnant woman has opted to purchase.

If you do face someone who has more difficulties in understanding what the scan that she has purchased involves you should:

  1. Take more time to explain the scan process
  2. Take advice from anyone who has arrived with the woman

Do everything that is reasonable to make sure that the woman does understand what an ultrasound scan involves.
